Preliminary Market Consultations

European Commission Library – Library Management System (Software as a Service)
The European Commission (EC) Library, managed by the Publications Office of the European Union (OP), is currently reflecting on the future evolution of its Library Management System (Software as a Service). In this frame, the OP has decided to launch a preliminary market consultation in accordance with Article 169(1) and with Point 15 of Annex 1 to Regulation 2024/2509, in order to:

  • develop general market knowledge (existence of sufficient suppliers to ensure effective competition);
  • assess the capability of the market to deliver what is required, within the required time-limits and on the required scale, and consequently the feasibility of the procurement;
  • gain knowledge of the terms and conditions usually applied to contracts in the relevant market and identify potential market constraints;
  • refine and further clarify its requirements and specifications without, however, having its needs influenced and determined by what the market offers;
  • make a correct estimate of the contract value;
  • gain understanding of potential risks of contract performance.

To facilitate the consultation, we have prepared a set of questionnaires that will serve as a starting point for a short oral exchange. The documents (letter and questionnaires) will be sent via email upon request which must be submitted through the EU Survey form by 11 April 2025, at 6:00 PM CET (Central European Time).
Interested economic operators are invited to complete and return questionnaires no later than April 22, 2025, at 6:00 PM CET (Central European Time).
Follow-up meetings will be organised after this date to discuss the completed questionnaires.
Please note that full confidentiality is ensured.

General reminder: this process is a Preliminary Market Consultation (PMC) and is not to be considered as a procurement or call for tenders.
Answers to two questions received concerning the PMC
1) request for an extension of the deadline for submitting the questionnaires: we confirm that the deadline to complete and return questionnaires remains 22 April 2025 at 6:00 PM CEST (Central European [Summer] Time).
2) question concerning 4a_LMS_Market_Consultation_Standard_DPA_Template: we would like to clarify that this document is referenced in question 1 of the document "Data Protection Questionnaire" (DPQ)("4_LMS_Market_Consultation_Data_Protection_Questionnaire.docx"). Question 1 of the DPQ reads: “if your company is selected as the successful tenderer, do you agree to conclude the data processing agreement (DPA), including its fully completed annexes (see template DPA)?”. In fact what we want to know is, if you were to be selected as the successful tenderer at the end of any potential procurement exercise, would you be able to agree to the terms of the data processing agreement (DPA), including all its fully completed annexes (as set out in the DPA template)?
Information on the follow-up discussions to take place after the closing date
We will be holding meetings with each economic operator who has completed and returned questionnaires within the deadline. These meetings will take place on Tuesday 13th May 2025. We kindly ask you to block this date already in your calendar and to send out a placeholder to the persons who will be representing your company on this day.
